I hereby declare I am of legal age and have provided a legal I.D. and I am competent to sign this agreement.Initial4. I hereby state that I have been fully informed of the procedure(s), and the potential complications and risks have been explained to me; including, but not limited to, bleeding, pain, swelling, infection, prolonged healing, scarring, nerve damage, fainting and allergic reactions.Initial5. I am aware that body art procedures are invasive and may involve possible health risks, especially for people with certain underlying medical conditions. I am also aware that I should consult with a physician prior to receiving any body art procedure. If I experience an adverse effect during the healing related to the body art procedure I have received, I have been advised to seek medical care as soon as possible, as well as advise the Body Artist and/or Body Art Establishment. I have been informed of the potential risks of body art. I still wish to proceed with the procedure.Initial7. I waive and release to the fullest extent permitted by law, the Artist and Body Art Establishment from all liability whatsoever, for any claims or cause of action that I, my estate, heirs, executors, or assigns may have for personal injury or otherwise, including any direct and/or consequential damage which results or arises from the procedure, whether caused by negligence or fault of the Artist, BOA Tattoo or otherwise.Initial8. I affirm that both the Artist and Body Art Establishment have given me instructions on care of my procedure while it is healing. I understand all of the instructions and will follow them adamantly. I acknowledge that it is possible that the procedure can become infected, particularly if I do not follow the instructions I have received.Initial9. Both the Artist and Body Art Establishment have given me full opportunity to ask any and all questions about the procedure. The staff has answered these questions to my complete satisfaction.Initial10. I affirm that I AM NOT under the influence of drugs or alcohol and I am voluntarily getting the procedure without duress.Initial11. I agree to reimburse each of the Artist and Body Art Establishment for any attorney's fees and costs incurred in any legal action I bring against the artist or body art establishment and in which either the Artist or BOA Tattoo is the prevailing party. I agree the courts of the State of Colorado and Larimer County shall have personal jurisdiction and venue over me and shall have exclusive jurisdiction for the purpose of litigating any dispute arising out of or relating to this agreement.Initial12.
